RE: The tariff classification of a jacket dress from Sri Lanka

Dear Hoffacket:

In your letter dated November 20, 2004, written on behalf of Hartstrings, Inc., you requested a classification ruling.

Submitted style H9618 is comprised of two lined pieces, each of which is manufactured from woven fabric of 65% polyester/35% rayon. One of these pieces is a sleeveless, empire-styled dress, vertically zippered at the back, ornamented by textile appliqués. The other of the pieces is a coordinated, long-sleeved, bolero-styled jacket.

As you have requested, the sample style is being returned.

The applicable subheading for the dress of this style will be 6204.43.4040, Harmonized Tariff Schedule of the United States (HTS), which provides for …girls’…dresses, of synthetic fibers, other, other, other, girls’; and for the jacket of this style will be 6204.33.5020, HTS, which provides for …girls’…suit-type jackets, blazers, of synthetic fibers, other, girls’. The duty rates will be 16 and 27.3 percent ad valorem, respectively.

The dress of this style falls within textile category designation 636 and the jacket of this style within 635. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
